Terms and Conditions

By hitting submit on your payment you are agreeing to be bound by all the terms and conditions listed below.

Expectations as it relates to material, stains, production time, and other processes:

- Wood is a natural product subject to natural imperfections and variations. The company will attempt to match all wood, but the customer understands that certain natural imperfections cannot be corrected.

- Racking made of Rustic Pine, Premium Redwood, and All-Heart Redwood will be made of solid edgeglued panels of the same wood as the wine cellar. Most other wood species the solid material will be made using MDF or Plywood with a veneer sheet of that matching wood species. Wine Cellar Innovations may substitute the edge-glued panels for plywood or plywood instead of edge-glued panels if required based on the manufacturing needs of your specific order.

- If you have requested a stain option, then you understand this is a semi-transparent stain for the wood.  Because the wood is a natural product, the stain will show the grain in all the wood.  Stain is not a paint, which would cover the grain.  Since it is a stain and not a paint, showing an excessive amount of grain pattern is and expectation and not a product defect .  In addition, the stain color will vary based on the material color it is applied to.  Additives to the stain are applied to ensure a relative consistent application, but some variation should be expected.

- Sample stain pieces:  You may request a sample of our stock stain sample free of charge for your order.  You can expect your order to have the same stain color applied.  Stain variation expectations explained in the above paragraph.  If you are placing an order for a custom stain match then we will require you to sign and send back a stain sample before your order goes into production to ensure the stain department has a matching piece to reference to your order during production.

- Lacquer application:  If the Standard Lacquer application was selected that is a single coat application with no sanding between coats.  This lacquer application may be rough to the touch, but will not tear the labels on a wine bottle.  If the Elite Lacquer application was selected that is a three coat application with sanding between the second and third coat.  That will be smooth to the touch.  If customer plans to lacquer the cellar on their own you understand that you will need to hand sand all of the racking before adding the first layer of lacquer and that you may need to touch up the stain on your own after the initial sanding.

- At time of order you will be provided an estimated ship date.  We will do everything within reason to ship your product based on this estimate date, but this is only an estimate, and is subject to change based on a number of variables.  If the production time should change on your order you will be notified as soon as possible with the new estimated date. The company accepts no liability for any claims or damages caused by the change in estimated shipping date.

- If you have elected to pay an additional fee to expedite and accelerate the timetable for your order, we will do everything within reasonable business practices to meet the requested ship/delivery date.  Should we be unable to meet expedited ship/delivery date you are eligible for a full refund of the expedited fee.  You may not cancel the contract for a custom order.  The company accepts no further liability for any claims or further damages resulting in any delays caused by missing the expedited delivery/shipment date.

- You understand that we do not have our own delivery system.  We select what we believe to be the most reliable freight carriers.  We will notify you when your product has shipped and provide tracking information related to that carrier.  We cannot guarantee that your product will be timely delivered once it is in the possession of the freight carrier.  Should the freight carrier not meet its delivery date, and you have paid any expedited shipping charge for a specific delivery date, then you will be eligible for a full refund of the shipping charges you have paid.  You may not cancel the contract for a custom cellar.  The company accepts no further liability for any claims or further damages resulting in any delays caused by missing the expedited shipping/delivery date.

- There are a variety of shipping options available to you.  If the shipping that was specified for your order does not meet your need, then discuss with your representative to find out the cost for changes to the shipping method.  The following definitions are to help clarify your options.

a) Standard shipping – If shipped via FedEX or UPS ground delivery please review their website for definitions of current transit times, list of services.  Understand the driver will take the boxes to your front door, but is under no obligation to place product inside your residence.

http://www.fedex.com/us/service-guide/our-services/us/index.html

http://www.ups.com/content/ca/en/shipping/time/service/index.html?WT.svl=PNRO_L1

b) Standard shipping via common carrier: Larger orders and packages may ship via common carrier.  The definition of standard shipping is that a 48’ or 53’ semi truck will deliver the product to the bottom of your driveway.  You are responsible for unloading it off the truck and taking it to the desired location inside your business or residence.

c) Common carrier you can request inside delivery and liftgate:  The driver will take the product down of the truck and place the skid inside your garage or any other reasonable location he can reach utilizing a skid mover.

d) Small Truck delivery:  A truck smaller than 48’, typically a 38’ box truck will deliver to your driveway, typically needed in remote or restricted areas.

e) 2 man delivery: If you would like the product removed off the truck and individual boxes loaded into your garage or the first area of access inside your doorway then you will want a 2 man delivery.

f) White Glove Service;  If you want the product taken off the truck, carried to any destination in your residence or business so that you or someone assigns is not required to do so, then you will want a white glove service quoted out.

- Should you choose to modify your order once it is in production, there could be additional charges. We will contact you with the amount of such additional charges as soon as those costs can be established.  You will then be required to pay that additional amount within 7 calendar days or before your product ships, whichever occurs first.

- Final Design:  Your signature on each design page indicates your agreement that the dimensions shown are the correct dimensions to manufacture your cellar to.  You are also stating the material, stain, and finish shown on the design are the choices you are proceeding with.  All prior communications as it relates to this project in regards to dimensions, wood, stain, and finish will be void as a result.  If a representative from Wine Cellar Innovations took the dimensions for the cellar, then we are accountable for the accuracy of those dimensions.  Any other party taking dimensions will put the onus on the Purchaser/Responsible party for accuracy of those dimensions.  Your cellar cannot go into production until those signed designs are returned.

- On custom cellars the bottle sizes for your wine cellar are indicated on your design on the key page. It is the responsibility of the client to review the design to ensure the bottle sizes shown will fit your wine collection.  For kit and commercial rack bottle sizes are located on the website for review.

Copyright waiver:  If you have submitted and image via photo or other image and you have requested Wine Cellar Innovations to create a unique piece of artwork that incorporates that image then you agree to the following conditions:

1) I have the right to permit Wine Cellar Innovations to use this image.

2) The content does not injure, infringe, or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the content may be viewed or retrieved.

- Fresco tiles may also come with plain tiles on the perimeter.

- All murals and paintings are one-of-a-kind and may vary slightly from photo shown on the website.  Wallpaper canvas paintings will require you to hire a third party wallpaper installer to work in conjunction with the installation of the racks.

- All rolling ladders are produced with a hook top.  Wine cellars that have curved corners will require the ladder to be picked up and manually moved around the corner.  This is standard ordering process and not a defect with the ladder.  There are no refunds eligible after ladder has entered into and/or completed production.

- All accent lighting such as Rope , LED, Xenon, or Halogen it is suggested to have them attached to a switched outlet if you should want to turn them off from time-to-time without unplugging them from the wall.

- E-Series Moldings have a repeating pattern.  Depending on the locations where your cuts will be made the pattern may not repeat at the location a miter is required due to length restrictions.

- All cooling units will follow manufacturer's warranty.  All WineZone units require a diagnostic sheet to be filled out before your warranty will be active with that unit.  You understand that if the diagnostic sheet is not sent in you hold Wine Cellar Innovations free and clear of all liabilities as it relates to this cooling unit.

- WCI does not provide installation of the WineZone system.  A qualified HVAC installer must have the unit mounted in place before installation can begin.  WCI will only install the items listed on this sign off sheet.  All electrical work will need to be done by a party designated by the owner or their assigned.

- If you have elected for Wine Cellar Innovations to install the racking for your order. The installation cost is based on the room being clear of all items, and ready for the installer to begin work immediately upon arrival to the jobsite.  WCI is not responsible for removing any foreign items from the room.  The installation cost is also based on the room construction being totally completed and ready for the installer to begin work immediately upon arrival to the jobsite.  Delays caused by incomplete room construction, or the presence of foreign items, may result in additional charges if a delay of more than 1/2 hour is required to correct the issues.

- The installer will require a workspace outside the wine cellar, in a dry and heated space, that will be used as a staging, cutting and assembly area.

- Upon completion of the job, the installer will leave the work area in a reasonable state of cleanliness, and will place any/all debris created by the installation in a refuse container, dumpster, or storage area supplied/designated by the customer or their assigned parties.

- If dimensions on the design are inaccurate and provided by someone other than WCI staff, then any additional hours needed to modify racking will be at customer's expense.

- With the exception of the Wine Sentinel units, WCI does not provide or offer any door knobs.  It is the customer’s responsibility to provide his or her own door knob and have it installed by a third party.

- Unless otherwise noted, the installer will also attach WCI base molding to all non-racked walls.  No base molding should be installed anywhere in the wine cellar by any outside party, prior to the installation of the racking.

- The majority of WCI racking options have an open bottom that allows viewing through to the floor.  All finish flooring (tile/wood/etc) must therefore be installed, throughout the entire wine cellar, prior to the arrival of the installer.  WCI installers do not install flooring.

- The majority of WCI racking options have an open back that allows viewing through to the wall behind.  All walls receiving racking must therefore be finish painted, floor to ceiling, prior to the arrival of the installer, as it is virtually impossible to paint the walls behind once the racking has been installed.  It is a common practice for builders and contractors to stop the sheetrock and painting several inches from the floor, in the assumption that base molding will conceal this unfinished area.  There will be no base molding behind the racking.  Any base molding purchased for the wine cellar is attached to the front of the racking.  Any unfinished sections of the walls behind the racking will remain visible and will be aesthetically unpleasing.

- If WCI installer is installing a Whisperkool or Breezaire units the opening must be cut before the installer arrives by a third party and must conform to the dimensions as noted on the floor plan.  A third party must provide the electrical outlet and drain line if required for the unit as specified by the manufacturer.

- In the event you have a bare concrete floor, it is in your best interest to seal the floor before the installation begins.  Without sealing a concrete floor you will most likely have humidity and other issues that may result in mold growth in your wine cellar.  Please sign here if you plan to have a bare concrete floor without a sealant and WCI is authorized to install the product and released of all claims associated with this issue.

- If the date and/or time of a scheduled installation is changed by you or your assigned parties within ten business days prior to your installation date, you will be charged a minimum of 5% of the original installation cost (These costs include, but are not limited to: idle installer labor time, incurred installer travel expenses, flight cancellations /rescheduling fees, deposits on rental equipment or vehicles, and shipping termination/redirection charges.)  A postponed installation will be rescheduled to the next WCI available date, which could extend to several weeks or months. These charges are in addition to your original install price.

- If WCI installer arrives onsite and it is determined that you are not ready (This includes, but is not limited to, walls not finished and/or painted, electric not completed, floors not installed, and/or can not have complete access to the space) you will be charged 5% of the install plus a trip charge of $750.00 and any additional fees WCI has accrued (These costs include, but are not limited to: idle installer labor time, incurred installer travel expenses, flight cancellations /rescheduling fees, deposits on rental equipment or vehicles, and shipping termination/redirection charges.)    These charges are in addition to your original install price.

- If there are any issues in relation to this project that cannot be resolved within 90 days of the start of resolution discussions, then all claims concerning this order shall be arbitrated in Hamilton County, Ohio, U.S.A. Parties agree that arbitrator shall have exclusive and original jurisdiction on any dispute and/or claims by either party.

- If any clause or provision of the Purchase Order Contract should be determined to be illegal, invalid or unenforceable under present or future laws effective during the term of the Purchase Order Contract, then, it is the express intention of the parties hereto that the remainder of the Purchase Order Contract shall not be affected thereby, and it is also the express intention of the parties that in lieu of each clause or provision of the Purchase Order Contract which may be determined to be illegal, invalid or unenforceable, there may be added as part of the Purchase Order Contract a clause or provision as similar in terms of such illegal, invalid or unenforceable clause or provision as may be possible and be legal, valid and enforceable.

Return & Cancellation Policies:

Custom Wine Cellar Return and Cancellation Policy

As a result of the custom nature of the product, neither individual components nor completed product can be placed back into inventory and used for another customer. Therefore, custom wine cellars are not returnable for any reason. The order will go into production once we receive the required deposit and a copy of the signed Purchase Agreement. If the cellar needs to be modified after the agreement is signed, The Purchaser will be charged a redesign fee of $262.50 plus the cost of any materials that have been cut that cannot be utilized in the redesigned cellar. If The Purchaser would like to cancel the cellar before it is shipped, the Purchaser will be refunded the deposit amount less a design fee andless the cost of any material that has been manufactured/cut.   In the event that the amount of material that has been cut exceeds the deposit on hand, The Purchaser agrees to pay Wine Cellar Innovations the remainder due to cover the costs of said material. The Purchaser will have the option to have the finished material shipped to the address of their choice at their expense or simply request Wine Cellar Innovations to discard material at no additional charge to The Purchaser.

Website Color Disclaimer
The wood swatches and photography that are represented on this website have been provided to give you a visual representation of the wood and stain options available through our organization. However, due to variations in individual user's monitor settings, calibrations, color printing settings, and lighting sources, we cannot guarantee that your wine cellar will be an exact match to the colors represented on this site. We would also like to explain that in certain wood species, the color changes as it ages over time. For example, most cuts of redwood gain a richer color as it ages. Coloring also varies throughout any given cut of wood grade, providing a broad range of shading and color density. We would like to also point out that there will be a variation that one can expect from a single sample of material, compared to the thousands of varying pieces that will be utilized in the final construction of your wine cellar racking or product. If you would like assistance with color matching for interior design purposes, you may request a free Material Spectrum Chart that is professionally printed to accurately represent the wood choices that you have selected. Please call and speak to a wine cellar consultant to discuss any questions or concerns that you may have, or to request a Material Spectrum Chart.

TO ACTIVATE YOUR WARRANTY THE INSTALLER MUST FILL OUT THE ENCLOSED DIAGNOSTIC SHEET AND RETURN THIS SHEET TO THE ADDRESS LISTED ON THE DIAGNOSTIC SHEET WITHIN 30 DAYS OF INSTALLATION. ALL VALUES MUST BE RECORDED WHILE THE CELLAR TEMPERATURE IS 53 ° TO 58 ° .

THERE IS NO CHARGE FOR YOUR INSTALLER TO CONTACT US WITH TECHNICAL QUESTIONS. EVEN THE CALL IS FREE AT 1-800-229-9813. UNAUTHORIZED MODIFICATIONS TO THE EQUIPMENT WILL VOID THE WARRANTY.

If there is a problem with the performance of your cooling unit have a certified HVAC/R technician contact the manufacturer (1-800-229-9813) and inform WCI of any problem(s). The technician needs to be prepared to provide updated information from the enclosed diagnostic sheet before calling for assistance. Our refrigeration manager will work with the technician to diagnose the problem and offer suggestions for resolving the issue. All recommendations for resolving issues will be based on information provided by technician. Any incorrect recommendations based on incorrect data will not be covered by this warranty. At our discretion, WCI will repair or replace any damaged or defective pieces due to manufacturing or shipping. If the part is defective due to an improper installation or use, then the consumer will be liable for the costs.

Warranty on replacement parts expires with the warranty from the initial retail sale.

Exclusions to this warranty:

1). Recommendations. If requested, WCI will provide names of HVAC/R companies that have installed our equipment satisfactorily for our past customers. We assume no liability for the satisfaction of the installation for your specific installation. Owner assumes liability to verify licensing and insurance of installation contractor.

2). Labor. WCI does not cover any labor expenses with our standard 12-month warranty. If you are interested in labor warranties we suggest you purchase a 5-year extended warranty, which will cover both labor and materials as described in the extended warranty terms and conditions.

3). Performance:. WCI designs their systems to maintain a temperature between 55-58 degrees Fahrenheit and 55-75% humidity. The condenser is a high performance system that will allow your system to vent into an area that is up to 110 degrees Fahrenheit and still maintain the 55 degrees in your wine cellar as long as there is sufficient air flow and space to allow the heat to dissipate, which is a space that is minimally twice the size of the wine cellar. When utilizing an indoor condenser we recommend that the ambient air temperature where the condenser is located not exceed 90 Fahrenheit. This is due to the time lapse in temperature dissipation of confined spaces. The humidity levels in your wine cellar will be maintained at a level between 55-75%, which means those levels must be present to begin with. If you did not purchase a humidifier with your system, we recommend you check the humidity level of your wine cellar (with a professional grade hygrometer) and add humidity to the air as required to get to the proper starting level. Seasonal changes around the cellar may also affect wine rooms not equipped with humidifiers. Improper room construction, undisclosed heat gains, or improper installation will limit the ability of the system to maintain proper humidity and temperature levels.

4). Physical or cosmetic damage. WCI will not be liable for any damage, deterioration or malfunction resulting from, but not limited to:

a). Installation or removal of the unit.

b). Installation of any unit in an enclosure that is inadequate for the designed system.

c). Inadequate ventilation of the supply and return air for both evaporator and condenser.

d). Inadequate installation of drainage or backup of drainage.

e). Accident, misuse, abuse, neglect, fire, water, lightning or other acts of nature, improper storage, unauthorized modification, electrical power surges or failure to follow instructions supplied with unit.

f). Exposure to corrosive environments such as, but not limited to, marine air, caustic pool chemicals, cleaning solvents, gasoline, and other petroleum products.

g). Burial or coverage by, but not limited to, dirt, snow, mud, storage shelves, fabric products, or vegetation.

h). Any cause which does not relate to product defect.

i). Improper refrigerant utilized to charge the system.

j). Normal maintenance as required as required is not covered.

k). Low or high voltage wiring external of the unit.

l). Loss of performance due to normal wear and tear.

m). Leaks in unit at evaporator, condenser and/or metering device as a result of loose valves, interconnecting fittings, and/or field piping. Leaks can develop in fittings during shipping, therefore all systems must be properly pressure tested and evacuated prior to charging.

n). Returned components without an authorization number from WCI.

o). This warranty is not transferable.

This warranty constitutes the entire warranty of Wine Cellar Innovations with respect to its refrigeration systems and is in lieu of all other warranties, expressed or implied. In no event shall Wine Cellar Innovations be responsible for any consequential damages of any nature whatsoever. Any modifications or unauthorized repair of a Wine Cellar Innovations refrigeration unit shall void this warranty.

We recommend that you have a service agreement with your installer setup for a yearly inspection and maintenance of your system. If you purchased a 5 year extended warranty these steps are required and it may have additional coverage, responsibilities, and /or exclusions not expressed herein. The maintenance schedule is as follows:

1). Keep evaporator and condenser coils clean and free of any obstructions.

If you wish to receive your replacement part immediately, you will need to provide a credit card onto which WCI will charge the cost of the replacement part(s). You have 30 days from the date we ship the part out to return the defective part. We will inspect it for the cause of error and refund your credit card if it is determined the error was a defective part or manufacturing error. If the part is received after 30 days there will no refund.

2). Labor. WCI does not cover any labor expenses with our standard 2-year warranty.

If you purchased a 2 year extended warranty these steps are required and it may have additional coverage, responsibilities, and /or exclusions not expressed herein. The maintenance schedule is as follows:

1). Keep evaporator and condenser coils clean and free of any obstructions.

2). Check motor(s) to see if any oiling requirements are needed.

3). Check refrigerant charge annually.

4). Check electrical connections annually.

5). Keep any heat sources away from thermostat(s).

6). Check gasket seals on doors and window for heat transfer.

We thank you for purchasing a cooling system from Wine Cellar Innovations and we look forward to serving you again in the future.

Proper Procedures for Cleaning Architectural Glass Products

Architectural glass products play a major role in the comfort of living and working environment of today's homes and commercial office spaces. By providing natural daylight, views of the surroundings, thermal comfort and design aesthetics, glass usage and condition often affect our selection of where we live, work, shop, play and seek education.

Architectural glass products must be properly cleaned during construction activities and as a part of routine maintenance in order to maintain visual and aesthetic clarity. Since glass products can be permanently damaged if improperly cleaned, glass producers and fabricators recommend strict compliance with the following procedures for properly cleaning glass surfaces.

As dirt and residue appear, interior and exterior glass surfaces should be thoroughly cleaned. Concrete or mortar slurry which runs down (or is splashed on) glass can be especially damaging and should be washed off as soon as possible. Before proceeding with cleaning, determine whether the glass is clear, tinted or reflective. Surface damage is more noticeable on reflective glass as compared with the other glass products. If the reflective surface is exposed, either on the exterior or interior, special care must be taken when cleaning, as scratches to the reflective glass surface can result in coating removal and a visible change in light transmittance. Cleaning tinted and reflective glass surfaces in direct sunlight should be avoided, as the surface temperature may be excessively hot for optimum cleaning. Cleaning should begin at the top of the building and continue to the lower levels to reduce the risk of leaving residue and cleaning solutions on glass at the lower levels. Cleaning procedures should also ensure that the wind is not blowing the cleaning solution and residue onto already cleaned glass.

Cleaning during construction activities should begin with soaking the glass surfaces with clean water and soap solution to loosen dirt or debris. Using a mild, non-abrasive commercial window washing solution, uniformly apply the solution to the glass surfaces with a brush, strip washer or other non-abrasive applicator. Immediately following the application of the cleaning solution, a squeegee should be used to remove all of the cleaning solution from the glass surface. Care should be taken to ensure that no metal parts of the cleaning equipment touch the glass surface and that no abrasive particles are trapped between the glass and the cleaning materials. All water and cleaning solution residue should be dried from window gaskets, sealants and frames to avoid the potential for deterioration of these materials as the result of the cleaning process.

It is strongly recommended that window washers clean a small area or one window, then stop and examine the surface for any damage to the glass and/or reflective coating. The ability to detect certain surface damage, i.e. light scratches, may vary greatly with the lighting conditions. Direct sunlight is needed to properly evaluate a glass surface for damage. Scratches that are not easily seen with a dark or gray sky may be very noticeable when the sun is at a certain angle in the sky or when the sun is low in the sky.

Over time, finishes may age or rub off due to weather exposure, frequency of use and metals or materials rubbing each other and are not covered by any warranty. This is considered a normal process that enhances the natural aging process and appearance of metal.

Damages caused by accident, misuse, abuse or improper installation are not covered by this warranty. Wine Cellar Innovations assumes no liability for any labor charges relating to installation, removal or re-installation of our products.

The LEDs are assigned a color Kelvin range of 4000K +/- 500K, all of which are considered within the "warm white" color range.   We cannot guarantee the LEDs for a cellar are all going to have the exact same number of Kelvins because most LEDs have a Kelvin variance of +/- 500K.
